I have examined the accompanying Ordinance, entitled
An Ordinance to amend the Pension Ordinance, 1862
and I am of opinion that the Ordinance is one which is not contrary to
the Governor's Instructions
This Ordinance authorize s the Governor-in-Council to
retire a Public Officer at the age of sixty.
Under the existing Pension Rules there is a Rule (No.21)
declaring that the Governor-in-Council is empowered to require any
Judge or other Public Officer to retire" from the Public Service of
the Colony at any time after he attains the age of sixty years.
This rule is without any statutory authority and is
therefore ultra viree
